Easyswim Terms and Conditions

 

Application:
 

1.     “Easyswim”, “its”, “we” or “our” all mean Easyswim Swim School Limited.

 

2.     These terms and conditions apply to:

 

a.     All parents, guardians, caregivers, spectators, sponsors, and to any other people affiliated with or connected to Easyswim (“you” or “your”).

 

b.     All Easyswim programme (“programme”) participants, including all children participating or present on any Easyswim premises.

 

3.     You are required to comply (and to ensure all children in your care comply) with all of Easyswim’s policies and procedures, as displayed or otherwise notified to you from time to time.

 

Bookings and Make Up Policy:

 

4.     Our year for lessons runs from 1 January to 31 December. Lessons are to be booked monthly in advance. If your booking falls on a public holiday that Easyswim does not operate on you will not be charged for that booking. 

 

5.     If the number of participants booked for a lesson falls below the minimum number, then the lesson may be rescheduled. If a lesson is rescheduled due to low numbers, you will be notified in advance.

 

Minimum numbers are as follows:

 

a.     Early childhood (3 months to 3 years) – 5 participants

b.     Preschool age (3 to 4 years) – 2 participants

c.     School age – 2 participants

d.     Adults – 3 participants

 

6.     If a participant is unable to attend a scheduled lesson, 48 hours’ notice is required to receive a make-up token. Where notification is provided within 48 hours of the lesson, you must provide a medical reason to receive a make-up token.

 

7.     Any token must be used within 12 months or it will expire and can only be used during a month where an active pre-paid booking already exists. 

 

8.     If a lesson is cancelled by Easyswim due to unforeseen circumstances, make-tokens will be provided to those participants.

 

9.     If there is a cancellation by Easyswim, this will be communicated via the IClass Pro portal. Please ensure push notifications are enabled.

 

10.  Make-up lessons must be booked no more than 5 days in advance and no less than 30 minutes before the start of the lesson.

 

11.  Sharks programme (Freyberg Pool Sundays) Easyswim runs a Have A Go day on Sundays up to four times per year. On this day Sharks lessons at Freyberg Pool do not operate as swimmers are encouraged  to participate in the Have A Go event which is part of the Sharks programme.

 

12.  Easyswim reserves the right to refuse admission and or withdraw a customer for any reason.

 

Payment:

 

13.  Enrolment in a programme will be confirmed once full payment is received within 7 days of booking.

 

14.  Fees are charged monthly and are payable in full in advance. Fees for the upcoming month will be raised  in the last week of the prior month, and processed on the last working day of the month. Payment will be accepted by correct cash at the pool, by direct debit (see also points 15 and 16 below) or by credit card (refer to point 17, below). Payment processing fees including direct debit, other transaction fees, third party processing fees and credit card fees are additional to swimming lessons fees.

 

15.  Payments by way of direct debit are made through the IClassPro portal accessed through our website. IClassPro uses a third party IntegraPay to process direct debit payments. You acknowledge that on providing your authority to process the direct debit, this will remain in full force and effect until such revocation of this authority.

 

16.  You acknowledge that if you choose to pay by direct debit, your bank account details will be retained for the duration of the lessons in order to process recurring payments. If any direct debit is dishonoured, you will be responsible for payment of any fees associated with the dishonoured payment. Direct debit/processing fees are in addition to lesson/service charges. 

 

17.  If you choose to make payment by way of credit card through the IClassPro portal you acknowledge that these details will be retained in the Iclass Pro system for the duration of the lessons in order to process recurring payments. You agree that you will be responsible for the credit card processing fee incurred by us when accepting payment.

 

18.  Easyswim may from time to time increase their fees for lessons. In the event of any increase to the amount of fees, you will receive advance notice of 7 days prior to the date that your next payment is due.

 

19.  If your account becomes overdue by 3 days, bookings may be removed, and enrolments cancelled, and any future participation will be on the basis of waitlisting pending availability and full advance payment. Easyswim will not accept new bookings or changes if your account is in arrears.

 

20.  Easyswim reserves the right to recover amounts owed to it by using third-party collection agencies. Amounts referred to a collection agency will incur additional costs and expenses payable in addition to the initial amounts owed.

 

21.  If a participant is absent for three lessons or longer due to an instance of illness or injury which prevents them from swimming, the participant is required to withdraw from lessons. You must provide written notice via email to book@Easyswim.co.nz. We may, at our discretion, give credit for lessons missed due to such illness or injury which is confirmed by a doctor’s certificate.

 

22.  When the participant has recovered from the illness or injury as outlined in point 21, please email book@easyswim.co.nz to rebook.

 

23.  Other than as referred to above, we do not give credits or refunds where payment has been made but enrolment is subsequently cancelled by or on behalf of a participant.


24.  Make-up tokens are valid for 12months from their date of issue and can be transferred between immediate family members of your account. Customers must have an active booking to schedule a make-up lesson. Make-up lessons can be booked up to five days in advance. Make-up tokens cannot be refunded or used as a credit towards your regular monthly lesson fees

 

 

Health and safety:

 

25.  You must advise Easyswim if you or any participant in your care, has any medical condition or special learning requirement. It is also your responsibility to ensure up to date information is provided to us.

 

26.  Participants are required to stay out of the water for two weeks after experiencing any diarrhoea or gastro-type symptoms. If any participant has recently been diagnosed with a notifiable disease, they must not swim and must seek medical clearance before returning to the pool.

 

27.  A child participant’s parent, guardian or caregiver is required to be poolside for the entire duration of the participant’s lesson unless advised otherwise.

 

28.  You and all participants will, at all times comply with all Easyswim health and safety requirements.

 

29.  To the maximum extent permitted by law, Easyswim accepts no liability for any accident or loss occurring or arising at any Easyswim premises or its surrounds.

 

30.  Pre Natal-Exercise - Easyswim takes the health and safety (or wellbeing) of expectant mums and their babies seriously. As with all physical exercise, there may be risks to an expectant mum depending on their individual circumstances and medical condition and history. Easyswim therefore strongly recommends that expectant mums consult with a medical professional such as a GP or midwife prior to beginning classes.

 

31.  Customers are expected to abide by school ground policies, specifically schools where dogs are not permitted.

 

 

Taking of photos and/or video:

 

32.  You will not take photos or record video of any child (other than your own or any child in your care), any Easyswim staff or any other person at Easyswim’s premises or its surrounds.

 

33.  You may however take photos or record video involving others where:

 

(a)   the photo and/or video is of an Easyswim award presentation involving your child or a child in your care, or of a team photo involving your child or a child in your care, or where Easyswim staff positively confirm to you that you may take a photo and/or record video involving your child or a child in your care; or

 

(b)   You have first obtained the prior consent of the subject of the photo and/or video, or where the subject is or appears to be under 18 years of age, the prior consent of their parent, guardian or caregiver.

Withdrawal policy

 

35.  You must provide written notice of cancellation before the 25th day of the current month to avoid being charged for the following month. If the deadline is not met, the booking will automatically roll over and the customer will be charged for the following month.

 

36.  All bookings are non-refundable, and no credits or refunds will be issued if you withdraw during the month. In the case of any early withdrawal, make-up tokens will be automatically issued to your account for any remaining lessons scheduled after the withdrawal date.

 

 

 

CCTV/video recording:

 

37.  You consent (for health and safety, quality control, and staff training purposes) to Easyswim operating fixed CCTV equipment at its premises (please note: a copy of Easyswim’s CCTV policy is available on request).

 

38.  You also consent to:

 

·       Participants being specifically recorded by Easyswim during their lesson, via other video recording equipment.

·       Easyswim recording you and/or other parents or caregiver’s poolside during lessons (e.g. where persons poolside may come into shot accidentally).

·       Such recordings being used by Easyswim at individual and/or group staff training sessions, over an unlimited period of time.

 

Parking

 

39.  You may not park your vehicle anywhere on school grounds at or adjacent to Easyswim premises before 4.30pm during school terms. Easyswim reserves the right to tow any such vehicle, which will be at your risk and cost.

 


Easyswim reserves the right to change these Terms and Conditions at its discretion.
